Disabled Orlando Residents May Be Entitled to Social Security Benefits

Every year, thousands of Orlando area residents obtain Social Security benefits. If you live in Orlando and cannot work due to a medical disability, you may qualify for monthly cash benefits. The Social Security Administration offers two different programs that provide qualified applicants with monthly cash benefits. Taking the time to speak with the experienced Social Security lawyers at Disability Advocates Group could benefit you and your family. If you’re entitled to benefits, we will help you submit a thorough and complete application. Our legal team will represent your interests throughout the application process. When necessary, we will appeal the denial of your claim before an administrative law judge.

The Difference Between SSI and SSDI Benefits

The Social Security Administration provides two different monthly cash benefit programs, Supplemental Security Income (SSI) and Social Security Disability Insurance (SSDI). While both of these programs provide benefits, the requirements for eligibility are different. SSDI benefits are based on a person’s disability work credits, while SSI benefits are based on a person’s limited income and resources, age, and disability. SSI benefits are needs-based, and disabled applicants must have a minimum monthly income to qualify. SSDI benefits are available for disabled applicants who have enough work credits from paying into the social security system.

Orlando Disability Hearings Lawyers

The first step in appealing your denial is to file a request for reconsideration. Should the Social Security Administration deny your request, you will need to request a hearing in front of an administrative law judge. During the hearing, an administrative law judge will ask you questions about your medical disability and how it affects your life. The judge will also ask you about your work history.

Disability hearings are less formal than typical Court hearings. The hearing will be closed to the public, and your attorney will be able to speak to the administrative law judge and present more evidence on your behalf.

In most cases, a vocational expert will be present, and the administrative law judge and your lawyer will be able to ask him or her questions. The goal of the administrative hearing is to present evidence of how seriously your disability affects your life. After about 45 to 90 days, you will receive notice by mail of the administrative law judge’s decision. If the judge denied your claim,  you have the right to request a review from the Appeals Court.

Applying for Social Security Benefits in Orlando

Applying for SSDI or SSI benefits can be complicated and frustrating. Applicants must submit a thorough work history and include documentation of their medical conditions. If you or your loved one are unable to work and would benefit from monthly cash benefits, it’s worth taking the time to speak to a lawyer about applying for benefits. The professional legal team at Disability Advocates group will review your situation and advise you on whether you qualify for benefits.

If you qualify for benefits, we will help you gather all the information you need to submit a thorough and complete application. The most important part of your Social Security benefits application involves showing that your medical condition is serious enough to prevent you from working in your current job or adapting to work in another job. We will help you gather the medical records and documentation you need to prove that you are entitled to SSI or SSDI benefits.

Orlando Social Security Disability Appeals

A social security claim examiner will review the application and determine whether the applicant is sufficiently disabled to qualify. The Social Security Administration denies most first-time applications.  In some cases, they deny applications due to clerical errors or a lack of information. In other cases, they deny claims because the applicant does not meet the eligibility criteria.  After you receive notice that the Social Security Administration has denied your claim, we recommend reaching out to Disability Advocates Group. We will review the reason your claim was denied and work to submit an appeal on your behalf.

Proving Disability in Orlando

Those applying for SSDI and SSI benefits must prove that their disability is severe enough to qualify them for benefits. You will need to prove that you have a medical disability expected to last at least 12 months or result in your death. You will also need to prove that your medical disability prevents you from working in your previous job, and it prevents you from adopting to work in another job.
